The decision in Devon and Somerset Fire & Rescue Authority v Howell & anor [2023] EWHC 257 (Ch) was published today. This case concerned the transitional provisions relating to the introduction of the normal minimum pension age of 55, and in particular the question of whether discretionary early retirement benefits are "actual" or "prospective" rights for the purposes of FA04, Sch 36.
