Judgment debt enforced against SIPP benefits

In Century Property (Leeds) Ltd v Aldiss [2025] EWHC 1348 (KB), the High Court has ordered the enforcement of a judgment debt against the debtor’s pension and lump sum benefits under a SIPP. In so doing, the Court applied the jurisdiction identified in Blight v Brewster [2012] EWHC 165 (Ch). The Court also gave the creditor’s solicitors the authority to sign the relevant documentation on the debtor’s behalf.

Readers will recall that the Court of Appeal has recently held that such orders cannot be made against a judgment debtor’s benefits under an occupational pension scheme, because of s.91 PA95: Manolete Partners PLC v White [2024] EWCA Civ 1418, a note of which can be found here. That provision does not apply to SIPPs.
