Ombudsman issues general guidance on overpayment cases

The Deputy Pensions Ombudsman has issued a determination following a complaint by members of the Bic UK Pension Scheme concerning the trustee’s attempt to recoup past overpayments of benefit out of future payments. The determination is of particular interest in that it sets out (at paras 41-55) guidance on the general approach that the Ombudsman will take on the recovery of overpayments under trust-based occupational schemes, whilst reiterating that each case will turn on its own facts.
