Virgin Media appeal rejected

The Court of Appeal has this morning dismissed the appeal in the Virgin Media case, upholding Bacon J’s decision that the effect of s.37 of the Pension Schemes Act 1993 and Reg 42 of the Contracting-out Regulations was to require the actuary’s written confirmation that an amendment continued to satisfy the reference scheme test, even if the alteration only affected future service benefits.
